Laying Out A Vision For The New Tech Economy

This week, the Attorney General spoke at a forum sponsored by NY Tech Meetup on the intersection between tech and government. In his remarks, the Attorney General outlined his vision of “responsible disruption,” a new regulatory framework that will nurture innovation and encourage new business models, while also identifying hidden costs to protect consumers and workers. After the Attorney General made remarks, a panel of experts from his office discussed the current state of technology, internet and anti-trust regulation, and took questions from an audience of more than 100.  The Attorney General’s remarks, as prepared for delivery, can be found here.

Protecting Homeowners From Mortgage Rescue Scams

The Attorney General is returning $400,000 to 14 Long Island homeowners who were victims of a mortgage rescue scam. Empire Property Solutions posted ads in local papers offering services to help families refinance their mortgages by turning over the titles to their homes through a “sale-leaseback” agreement, but failed to make good on their promises to use the payments to pay down their mortgages. In the end, the homeowners faced foreclosure and eviction. In response to an uptick in reported mortgage rescue scams, the Attorney General launched AGScamHelp.com, a web-based app that helps families report scams and connect with qualified housing counseling and legal services across the state. In less than a year, more than 26,000 New Yorkers have visited the website.

Welcoming Aboard Tim Wu

The Attorney General announced the appointment of Columbia Law Professor Tim Wu as Senior Enforcement Counsel and Special Advisor to the Attorney General. Wu, who coined the phrase “network neutrality,” has an unparalleled depth of understanding of the intersection between technology and the law. Wu will advise Attorney General Schneiderman on technology, competition, internet policy and legal issues. Wu also previously worked at the Federal Trade Commission during the first term of the Obama administration.

Working To Stop Public Corruption

Attorney General Schneiderman joined U.S. Northern District Attorney Richard Hartunian and State Comptroller Thomas DiNapoli in announcing the conviction of former Assemblyman William Scarborough on fraud and theft convictions. Scarborough was sentenced to 13 months in prison on charges he submitted more than $54,000 in fraudulent travel vouchers during his time as a member of the New York State Assembly. Scarborough falsely claimed he had been at the state capitol for legislative business when, in fact, he was not in Albany, and he inflated the amount of time he reported he spent in Albany in order to receive a larger per diem. Scarborough’s sentence crystallizes the need for comprehensive reform to clean up corruption in our state, an effort that the Attorney General has been leading.

Cracking Down On Tax Fraud

Attorney General Schneiderman joined Commissioner of Taxation and Finance Jerry Boone in announcing the guilty plea of an Ithaca businessman for failing to pay sales and personal income tax to the state. Between 2005 and 2012, Jonathan Pargh underreported the taxable sales for his two companies and his business income by more than $1.6 million, defrauding the state of more than $280,000. This conviction makes it clear that when unscrupulous business owners break the law, they will be held accountable to the fullest extent of the law.

Stopping Unlicensed Immigration Providers

The Attorney General has shut down Entertainment Visa Consultant Company (EVC), resolving allegations that the company and its owner were providing unauthorized immigration-related services. EVC processed hundreds of temporary work visas for foreign entertainers, submitting these applications to federal immigration authorities. But an investigation revealed that EVC is not an accredited organization, and neither the company’s owner nor staff were licensed to practice law in New York. The Attorney General is committed to stopping the unauthorized practice of law and protecting New Yorkers from fraud by enforcing immigration service provider laws.

Ending On-Call Scheduling At Bath & Body Works

The Attorney General announced an agreement with Bath & Body works to end on-call scheduling in all U.S. stores. On-call scheduling can cause serious disruptions for workers by disrupting their plan for childcare, transportation, and other basic needs. Bath & Body Works joins Abercrombie & Fitch, Gap, and Victoria’s Secret in ending this troubling employment practice in response to the Attorney General’s inquiry, which has yielded more stable, reliable work schedules for tens of thousands of employees.

Fighting Back Against Gender Discrimination

Attorney General Eric T. Schneiderman and the U.S. Equal Employment Opportunity Commission (EEOC) reached a joint settlement with Consolidated Edison Company of New York, Inc. (Con Edison) to resolve allegations of ongoing sexual harassment and discrimination against women in field positions. These women, who work alongside men in power stations, manholes, and other physically strenuous field positions, alleged they were given sub-par training, assigned menial tasks and denied adequate restrooms, showers and changing facilities. As part of the agreement, Con Edison will reserve up to $3.8 million to compensate as many as 300 women who worked in the field from 2006 to 2014 and suffered sexual harassment and discrimination. This case should send a clear message to employers across New York: All women, especially those working in male-dominated workplaces, deserve respect and equal treatment.

Continuing The Crackdown On Herbal Supplements

As part of his continued efforts to reform the herbal supplements industry, the Attorney General announced that his office sent 13 cease-and-desist letters to the manufacturers of the herbal supplement devil’s claw, which is marketed as a treatment for arthritis and other forms of joint pain. The letters were sent after the New York Botanical Garden tested more than a dozen devil’s claw supplements labeled for U.S. sale and found that all supplements identified via advanced DNA barcode testing contained a different plant than advertised. The study’s results raise more troubling questions about the manufacturing and marketing of supplements. A 14th manufacturer, Nature’s Way, has agreed to reform the manufacturing and marketing of its supplements, in addition to refunding New York consumers who have purchased its devil’s claw products since January 1, 2012.

Working With Comptroller DiNapoli To Protect State Benefits From Fraud

The Attorney General and Comptroller Tom DiNapoli announced that a Florida resident pleaded guilty to stealing more than $275,000 in New York State pension benefits that were issued to his deceased mother. Marc A. Eletz is expected to be sentenced to one year in jail and will sign a $1240,000 judgment on top of the $150,000 he has already paid in restitution. This case is the latest joint investigation under the Attorney General and Comptroller’s Operation Integrity partnership, which has resulted in dozens of convictions and more than $6 million in restitution.

Stopping Nursing Home Theft

A former Hudson nursing home employee has been arrested on charges she stole more than $6,000 for a resident trust account at a nursing and rehabilitation center in Columbia County. Claire Wieland, who was the responsible for submitting request to have checks drawn for residents who requested funds, allegedly possessed 24 fraudulent checks. Wieland allegedly then cashed the checks and kept the money for herself. The Attorney General will not tolerate those who seek to exploit nursing home residents for personal financial gain.

Returning Stolen Money To Medicaid

A Yonkers man has been sentenced for stealing more than $200,000 dollars from Medicaid. Kurien Palliankal, owner of Carewell Ambullete, billed Medicaid for more expensive transportation than was medically necessary over a period of four years. As a result of his actions, he was sentenced to six months in prison and five years of probation. Carewell Ambulette, formerly based in New Rochelle, was also sentenced to pay a fine of $10,000. The Attorney General will continue to protect New Yorkers’ access to honest and reliable medical services by rooting out Medicaid fraud.

Uncovering Forged Narcotic Prescriptions

A Schenectady-area nurse has pleaded guilty to illegally obtaining more than 2,000 narcotics using forged prescriptions. For approximately one year, Linda Masse used 18 forged prescriptions at Walmart and CVS from her employer’s practice, causing Medicaid to foot the bill. The Attorney General will continue to hold medical professionals accountable for crimes committed by the abuse of their privilege.

In Other News…

With Vice President Biden in town to advocate for a higher minimum wage, the Attorney General expressed his support for a livable wage for all New York workers.

The Attorney General announced an election day hotline for this week’s primary elections, allowing voters to report any barriers to access at polling sites.

The Attorney General issued a statement commemorating the 14th anniversary of the 9/11 attacks.

Yeezy Season is Approaching!

Yeezy Season 2 is on it way and from the sources we here this collection won’t have anything to do with adidas originals. The show which no one knew would be scheduled has now disrupted designers plans for NYFW as we are told many do not like that Kanye is allowed to be added to such a hefty list of shows that was already booked for NYFW. But guess what, Yeezy gets what he wants and that means he will be presenting his Yeezy Season 2 collection Wednesday at Skylight Modern on 537 West 27th Street and Vanessa Beecroft will perform. This is very dope news for Yeezy fans and lovers of high-fashion x street-wear. The Yeezy supply website has been updated with a new video of long-sleeve camoflauge t-shirts with invites to the show.

Hood By Air 2016 Spring/Summer NYFW Collection

Hood By Air gives us zippers, strips and more at NYFW

Hood by Air was at NYFW to debut their 2016 spring/summer collection and by the looks of things the collection was not surprising at all. Shayne Oliver drew inspiration from something a bit different for his collection this time as he say’s “It was all about childhood in the Caribbean. And growing up around uniforms. We had such high education, and we couldn’t do anything with it—high education and low living quarters. So it was about cutting up and altering that school uniform, as we did”. The collection featured multiple pieces with leather, zippers and strips, neoprene body suits and silk dresses were seen on the men with a dash amount of makeup. The collection might have left many a bit confused by who was who in gender walking the runway but at least Shayne got his point across. Check out some of the images of the Hood by Air spring/summer 2016 collection presented at NYFW in the gallery below.

Hood By Air Spring 2016 features a Nike Air influenced high heel

Uptempo

Amongst avant-garde looks and inventively proportioned clothing items, Shayne Oliver creative director of Hood By Air seems to have taken inspiration from a retro and classic Nike model with the creation of a new pair of Woman’s heels. At the recent Hood By Air New York Fashion week show, models strutted down the runway donning multiple color-ways of heeled shoes with the word “AIR” highly visible on the side panelings. Sneaker enthusiasts and people paying attention to kicks in the mid 90s remember the Nike Air More Uptempo with admiration and reverence. Chicago Bulls Scottie Pippen chose the Uptempo as his signature sneaker and the shoes transitioned successfully to massive off court appeal. Hood By Air has a history of reinterpreting classic Nike models, earlier this year the brand meshed classic Nike Huarache like tooling with the storied Timberland boot construction.

Shayne Oliver decided to pair his creatively invigorated designs with new showings of officially branded Nike Air sneakers as well, outfitting both female and male models in the Nike Air Flight 89. The Flight 89 was briefly available on Nike ID last year. The first sneaker to bear the “Air Flight” title, 1989’s air flight displayed an innovative design and completely influenced the coveted Air Jordan 4 with it’s distinct look and striking midsole. Hood By Air as a brand has always melded the worlds of streetwear and urban style with a high fashion detail and presentation, dedicating itself to an aesthetic a host of other designers also used this recent New York Fashion week. View more images of the Nike Uptempo inspired heels and shots of a few progressive high fashion Air Flight 89 pairings in the gallery below.
